Election of Settlement Officer and Assistant Settlement Officer


1) As mentioned in article 22 of the Electoral Rules, any resident of the settlement irrespective of gender and faith, who qualifies for the post can stand in election of settlement officer or assistant settlement officer.
2 Voters
a) residents of the settlement who are qualified voters
b) voters for the assistant settlement officer are the members of local assembly. Assistant settlement officer can be elected with the consent of two-third majority of local assembly.
3) There shall be no election for Representatives of the Offices of Tibet

Qualifications for Settlement Officer and Assistant Settlement Officer


1. Candidate must be a citizen of Tibet
2. Candidate must have completed 25 years of age
3. Candidate must not have been declared insane either by a qualified doctor or a court of law
4. Candidate must not have unsettled public dues or debt
5. Candidate must not be a convict or found guilty by the court of law
6. Candidate must not be the staff of CTA
7. Candidate must not be entrusted with task, entitled with any rank or position, granted with cash or kind by any other country to harm or work against the interest of Tibetan people.
8. Candidate must not have violated the Election rules and regulations passed by the Tibetan Parliament-in-exile
9. Candidate mustn’t be the one who has been proved to be working against the Tibetan cause directly or indirectly.
10. Candidate must not be an incumbent settlement officer or assistant settlement officer who have been working for two consecutive terms.
11. Candidate must not be someone who is proved to have no faith in the Tibetan Charter

Voting of Settlement Officer and Assistant Settlement Officer


1 a) Depending on the size of population, residents of settlement have to
nominate one candidate for the preliminary election
b) Candidates wishing to withdraw their nomination can do so within 3
days
c) Excluding withdrawn candidates, the two highest scorer of votes shall be the candidates for final election. In case there is only one candidate and if he/she secured not less than 51% of vote, he/she shall be selected and declared as uncontested settlement officer, otherwise, there shall be re-election.
2. If an incumbent member of local assembly or local CTA staff or NGO staff
is elected for the Settlement officer or Assistant Settlement Officer posts, he/she will have to resign from the current post held.

Announcement of election result of settlement officer

After the vote count, the Regional EC shall declare the name of newly elected settlement officer to the public and report the same to the concerned higher authority.

 

Term of Settlement Officer


1. Unless the Settlement Officer and Assistant Settlement Officer gets dismissed as per the article 91 of the Tibetan Charter, their term of office is 3 years
2. As and when there is a vacancy for the post of settlement officer and assistant settlement officer, the new replacement has to be elected within 30 days.
3. There is no objection for the re-election of settlement officer or assistant settlement officer. However, one cannot hold the post after two consecutive terms.
